WHAT ARE LAND RECORDS?
Land records are public documents that include deeds, wills, deeds of trust, liens, releases, financing statements, etc. The persons or entities that require land records or title searches must do the research themselves, or hire a licensed attorney or title company to conduct the search. Deputy Clerks are available to assist you in the records room but cannot do the search for you.
RECORDED DOCUMENTS
Transactions involving real property located within the County of Gloucester must be recorded in the Circuit Court Clerk’s Office Record Room. All documents presented for recordation must be signed and notarized original documents. Faxed copies are not acceptable. Cover sheets are not required.
Copies of recorded land records from 1989 through present are available on the public computer in the record room. Land records prior to 1989 are kept in bound books located within the record room and vault. Copies are 50 cents per page for letter and legal size documents, and $1.00 per page for documents larger than 8 ½ by 14. The fees for Certification is $2.00 per document.
NOTE: DOCUMENTS WILL BE REJECTED IF THEY ARE NOT IN PROPER FORM WHEN PRESENTED FOR RECORDATION.
RECORDING REQUIREMENTS
- The document must be original. Must be signed and the original signatures properly notarized.
- Must be accompanied by recording fees payable by cash, money order, or check payable to the Clerk of Circuit Court.
- Documents relating to real estate must include a Tax Map Number. You may obtain this number from the Commissioner of the Revenue's Office (Telephone No. 804-693-3451) or the Gloucester County Property Records Website.
- All documents to be recorded must comply with the requirements specified in the Library of Virginia’s Standards for Recorded Instruments and Standards for Plats (insert).
RECORDING FEES
If the fee presented with the recording is short, the recording will be rejected until additional funds are provided. If the recording fee is in excess of monies up to $25.00, it can be recorded; however, the additional funds will be deposited into the Clerks Office account and not refunded. to process.
