Gloucester Man Banned From Booze For Life

GLOUCESTER

A Gloucester County judge ruled today that 41-year-old Michael S. Roberts is an "habitual drunkard" in the state of Virginia and can no longer legally consume alcohol.

The decision comes after Roberts racked up 10 drunk in public convictions in the last seven years.  The assistant commonwealth's attorney also alleged that Roberts assaulted his wife and son while drunk.

The title, "habitual drunkard," is a little-used Virginia statute that has been on the books since 1950. 

Roberts' sentence is a Class One misdemeanor, punishable by a $2,500 fine or up to a year in jail.

A penalty also applies to anyone caught selling Roberts alcohol, though Gloucester County deputies rarely enforce the law against sellers.

The judge told Roberts he can appeal the decision but that he would also consider lifting the "habitual drunkard" moniker if Roberts can stay sober for an extended period of time.
